Asas dan Jenis Akad dalam Hukum Ekonomi Syariah: Implementasinya pada Usaha Bank Syariah

Abstract

It has been more than two decades since Shari’a Economic Law was introduced and  vastly grew in Indonesia. For that reason, a thourough study is needed to describe the principles, types, and implementation of ‘akad’ (deal) in this special law. This study reveals that a deal in Shari’a Finance & Economic Law is consisted of several principles, i.e. balance, fairness, and consensualism. Meanwhile, types of deal to be found in Shari’a Economic and Finance Law are buying and selling, renting, outcome distribution, service/fee, and pure saving. Under the new law and regulation,  there’s a lot possibility of service could be offered by Shari’a Bank than conventional management bank.
